Estate Disputes

Disputes can arise for many reasons.

  • The validity of the Will. This includes many types of issues such as, mental capacity, knowledge and approval, suspicious circumstances and undue influence.
  • Family provision claims. This is where an eligible person has been left out of a Will or left without adequate provision.

We can assist with a range of disputes involving a deceased estate as well as disputes involving enduring powers of attorney.

Estate Administration

Estate administration is the process of dealing with a deceased’s assets and liabilities and distributing the estate to beneficiaries. Administering a deceased estate can be an overwhelming and complicated process. A person appointed as an Executor in a Will has extensive duties and obligations ensuring an estate is properly administered.

We understand it is a difficult time for family and friends when a loved one passes away. We provide Executors with clear and concise information regarding their obligations and the process.

We also assist beneficiaries who require legal advice about their entitlements as a beneficiary of an estate. The administration process can also be stressful for beneficiaries, particularly where there has been some breakdown in the family unit.

There are many legal requirements to be aware of when preparing and signing a Will for it to be a valid document. It is important for your Will to be prepared correctly and that it is kept up to date.

Seeking the assistance of a Wills and Estate professional provides peace of mind that your wishes are accurately documented. We work with our clients to ensure they receive the advice they need to properly protect their assets and that those assets are distributed according to their wishes.
